Terms and Conditions
The Canada Coffee members rewards Club is exclusive to Canada Cupcake Café S. Coop. V., C/ San Francisco 64, Alicante 03001, Spain, trading as "Canada Coffee", hereafter referred as the "Club".
Membership to the Club is open to anyone above 13 years of age with a valid ID (Spanish DNI, Spanish NIE residency card, or international passport). To join the Club, you must register your details online. You may opt to collect a physical card in store, at a cost of 2€, not refundable. Canada Coffee may grant or refuse membership at its absolute discretion. Each member is only permitted to have one membership which will be allocated to one nominated ID and name when the member registers. Each ID may only be used for a single membership (except with the consent of Canada Coffee). If granted membership to the Club, Canada Coffee will enter your contact details in the Club database and activate the account with 150 welcome points. All members of the Club are required to communicate any changes to their personal details as soon as possible after that change, either in person or online.
Club members must present their valid photo ID they registered with, or valid Club member card to accumulate points to their account. Canada Coffee may offer additional points to some or all members of the Club from time to time. These offers may include additional terms and conditions. It is at Canada Coffee's sole discretion whether to issue you with a special offer. Members of the Club accumulate points on their account to the value of 10 points to every 1 Euro spent on any item purchased in-store, upon presentation of valid ID or the physical Club card. On certain days or with certain offers, additional bonus points can be accrued. Subject to clauses 1 to 4 (below) of these Terms and Conditions, 400 accumulated points can be redeemed in-store for Canada Coffee menu items such as custom beverages or baked goods, subject to availability, excluding optional add-ons or promotional discounted items.
1. Points cannot be used as a full payment or a partial payment.
2. Points cannot be redeemed for cash.
3. Points will not be accumulated nor redeemed in respect to any purchases of promotional items, and cannot be accumulated in combination with other offers, coupons, vouchers, discounts, etc.
4. The freebie cannot be redeemed for retail products (such as bags of coffee beans, boxes of tea, etc), nor for items such as boxes of cupcakes, cakes, personalized orders, etc.
When reached 400 points they will automatically be subtracted from your account and converted into a free item. You will then automatically receive an email to redeem your freebie within 30 days. It is your responsibility to check your email and present in person within 30 days to claim your gift. To redeem you must do so in person with your valid ID that you registered with, or valid Club card. All unclaimed free items or special items will expire as per communicated dates specified in the relevant emails. Free items, Club cards, special offers and members discounts are non-transferable and are not redeemable for cash. All special offers are subject to availability. Canada Coffee is not responsible if a special offer is not available on the day you come to redeem your special offer and you must release Canada Coffee and store operators from any claim and from all liability arising out of your inability to redeem such special offers.
If you have not gained points on your Club account thru an in-person purchase for a period of 90 days, your account will automatically be zeroed. Accumulation of points thru lottery, contest or any other courtesy gifts do not count towards maintaining your account active. Once your Club account is deactivated your accrued points and any other entitlements will automatically expire.
You can to-up your account in increments of 20€. The credit you add onto your card is entirely yours, to use anytime you want within 180 days from your last purchase. Paying with your Canada Credit entitles you to accumulate points faster. When using your Canada Credit, the receipt will print out your current and remaining balance. Canada Credit can be used towards the purchase of products offered at Canada Coffee, has no monetary value and is not redeemable for cash except as otherwise provided by law. Canada Credit may be accumulated. Purchase amounts that exceed the value of your available Canada Credit will require an additional method of payment for the balance due. Canada Credit can only be used by the account holder, and cannot be transferred to another person or account. The Canada Credit amount expiration date is 90 days from your last purchase date. To automatically renew this period you need to make a purchase using Canada Credit from your account. An email notification will be sent to your registered email prior to the expiration date. Expired Canada Credit will be disabled from your account, without exceptions.
Lost or Stolen Card
If you lose or no longer possess your Club member card please present in person with a valid ID. Canada Coffee will check the Club database for your membership. Providing you are an existing valid member in the Club database your card will be replaced at the cost of 2€, not refundable. If, for any reason, Canada Coffee is unable to confirm that you are an existing member in the Club database, you will be required to reapply and register in accordance with these Terms and Conditions. Such registration will be for a new membership and any points previously accumulated will not transfer to the new membership.
Canada Coffee reserves the right, in its absolute discretion, to suspend your membership in the event that large or suspicious credit loads accumulate on your Club account pending investigation into the accumulation of that credit. Canada Coffee may terminate your membership if it considers you have used your Club account fraudulently or otherwise in contravention of these Terms and Conditions or the law generally. Canada Coffee reserves the right to remove accumulated points incorrectly or accidentally added to your Club account, without notice to you. Members must not provide false or misleading information to Canada Coffee and must not alter, reproduce, disclose or in any way interfere with the details of other members. Canada Coffee reserves the right at its sole discretion to disqualify or suspend and/or delete any credits or entitlements accrued by any member who does not comply with these Terms & Conditions and may do so without notice to that member.
Canada Coffee accepts no responsibility for any message, e-mail or other correspondence not received by members or for any delay in delivery due to technical disruptions or for any other reason. Canada Coffee is not responsible for any incorrect or inaccurate information, either collected at the time you registered as a member or during the course of your membership, either caused by a Canada Coffee employee, or for any of the equipment or programming associated with or utilized in this service, or for any other technical error, or a combination thereof that may occur in the course of the administration of this service including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorized access to or alteration of member's contact details. It is your responsibility to maintain the accuracy of your personal information entered in the Club database, either in person or online.
Limitation of Liability
Canada Coffee is not liable for any damage whatsoever which is suffered (including but not limited to consequential loss) or for personal injury which is suffered or sustained, in connection with membership of the Club or with any of the special offers, except for any liability which cannot be excluded by law. In all matters, all decisions of Canada Coffee will be final and cannot be contested and the member hereby agrees to accept such decisions. If for any reason this service is not capable of running as planned, including but not limited to infection by computer virus, unauthorized tampering, or any other causes beyond the control of Canada Coffee which corrupts or affects the administration security, fairness, integrity or proper conduct of this service, Canada Coffee reserves the right at its sole discretion to cancel, terminate, modify or suspend the Club. Otherwise Canada Coffee reserves the right at its sole discretion to change these Terms and Conditions, the terms of any of its special offers or the Club at any time without notice to you other than a general notice displayed on the Club website.
